To the St.Peters Lutheran Congregation at Serbin, Lee County, Texas
Dear Brothers in Christ!
We are really now very sorry, for your sake, that in your writing, you consider yourself completely innocent and righteous regarding the 1870
separation. Should you not, as Christians, have realized that, especially at a separation and rift in a congregation, the sinful nature of Christians
tends to become a mighty penetration in the sanctuary? Do you really claim, and stick with that claim, that you alone dealt correctly and therefore,
were innocent of that sad event that, at the time, took place in the congregation in Serbin?
You say in your writing: “We are convinced that in the year 1870 a separation in the Evangelical Lutheran Congregation in Serbin, Bastrop County,
Texas took place, and that, in fact, it was after the resignation of his office by the sainted Pastor J. Kilian”. Certainly, as concerns the
historical evidence, the separation took place first after the resignation of his office by the sainted Pastor J. Kilian. But this separation in
1870, dear Brothers, could not have happened, just from the case of the resignation from his office of the sainted Pastor J. Kilian, when the actual
much worse separation before God had completely taken over, namely, the inner separation of the hearts and the souls. Or is that an unimportant
matter when the inner disunity in a congregation separates the hearts? Is only the outer separation bad? Is not the inner separation the preliminary
and actual cause of the outer separation, and which is much worse and more dangable? Each one of you must admit each time, that from the inner
separation and split of otherwise Christian hearts, grew the final sad fruit? And now we ask you: Does not the history of the Serbin congregation at
that time, clearly show that the separation did not first happen with the resignation, but began, unfortunately, in the fall of 1869 when the sad
separation had already fully set in? Despite all the still existing outward association, the congregation, at that time, was really torn apart and
had split into two parts. This is shown by the meetings held at that time, which, through bitterness and quarreling, had reached the point of a sad
‘persistance’. That is also further shown by the total work stoppage of the church at that time, because of the inner rift, when the progess of the
further construction of the stone church was hindered, which before had been agreed to by the whole united congregation, but had been taken hostage
and now was completely disrupted. That is also shown by the letters at that time by the sainted Pastor J. Kilian, and finally also the letter by the
sainted President Bünger to the sainted Pastor J. Kilian dated October 18, 1869, who wrote the following: I hope, so wrote President Bünger, that the
flames of the controversy, if not extinguished, would still be dampened by the communications with your congregation and by the efforts of Mr. Wukasch
with the interview of Mr. Leubner. We did have a meeting regarding this matter in Fort Wayne. In the same, Pastor Fick, Director Lindemann, Mr.
Wukasch and I were present. In general, we could not condone the conduct of Mr. Leubner. It would make me feel very bad, if Mr. Leubner would not be
satisfied with that. I would not be afraid of that. I would also hope that the congregation would again be ‘whole’, and that there would not be two
parties. His departure shows at least, that, already in the fall of 1869, that the congregation in Serbin had to be innerly split and torn apart.
Mr. Wukasch, a now still living member of the St. Peter Congregation, would certainly testify any time that the above mentioned discussion really
took place at the Alleghany Synod in Fort Wayne, and for anyone interested, the letter from the sainted President Bünger can be made available by
Pastor H. T. Kilian for inspection.
Yes, if the congregation in Serbin had not already been torn apart and split before the resignation from his office by the sainted Pastor J. Kilian,
why was it then necessary, that Visitor Brohm in 1870, shortly before the resignation from his office by the sainted Pastor J. Kilian, was earnestly
concerned to bring about a unification and reconciliation. The proof for these circumstances could not be the more clear than words could do, that the
rift in the Serbin congregation was not created at first by the resignation, but was already present before that. It was just on the well known fact
of the inner conflict that the sainted Pastor J. Kilian, without contradiction, could be called, and which formed the basis for his official
announcement. From all of this, it follows that it is false, if one puts forth the proposition that the separation came about and was created by
the resignation from his office by the sainted Pastor J. Kilian. No, the inner separation, although regrettable, was not amazing, but was a
necessary result of the conditions at that time of inner rift.
Now, beloved Brothers, who were involved at that time, can you, looking back to the years 1869 and 1870, claim to be free from blame? Are you not
equally guilty for that inner separation of otherwise Christian hearts? That those churchly abuses and those impossibly difficult relationships, which
you point out in your writing, were of your own aggravated creation? Do you not find, when your conduct at that time comes under the first
examination, there are sufficient reason for self humiliation? Was it not alone reprehensible that you at all were the people in the party? For
this, can a Christian become a participant in a party? Further consider this, that for your part in the controversy at the time, you not once could
show an honorable reason. It was not a matter of doctrine. It was not the malicious unfaithfulness or ungodly living of the Pastor at that time. In
short, such a basis was never present that would be biblically valid and honorable. And in spite of all this, there was great bitter fighting and the
congregation was divided. Is it now not sinful, when Christian fight among themselves, and that without any justifiable biblical grounds? Or could
you name any valid grounds for the controversy at that time? The sainted Pastor Palmer, before his departure, at least, as a Serbin resident and the
minister of the St. Peter congregation, evaluated the situation in a letter to Pastor J. Kilian: “I am not clear regarding the actual reason
throughout for the separation in your congregation”. We can conclude from this, that there did not exist any actual valid and justifiable reason or
that it should have been easy to convince a called minister of this. The copy of the mentioned letter can be had from Pastor H. Kilian.
You say in your writing: “We hold to it, that when a pastor resigns from his office, the congregation finds itself constrained to call another one”.
The justification for this statement everyone will agree to be self-evident. Certainly a congregation has to call, but remember; but actually then it
has to be the whole congregation which does the calling, and not one disagreeing party from the congregation. Since you proceeded at once, after the
resignation from his office by the sainted Pastor J. Kilian, to call a new minister, you were not the true congregation in Serbin, but a separate
party of the Serbin congregation, and as such you did the calling. Had you not wanted to call as a party, you would have made a temporary vote, and
for the same election you would have negotiated beforehand with the larger party of the congregation for a possible joint action in the calling
matter. Without such a coming together, each election at the time would have to be regarded as a one-sided party election. What under otherwise
normal relationships is, without doubt, right in a congregation, namely that the absent members forfeit their voting rights, can not in any way be
applied where the conditions of a congregation itself is the rule, for example, when the two parts are isolated from each other, and the one part does
not recognize the resolutions of the other part as being binding. So as the matter stood at that time, as you further say, Pastor Palmer was called
as the Pastor of the congregation. But you should have said, if you did not want to seem to be intolerant: Our party called Pastor Palmer. Or was it
too much to ask, that the majority, rather than the minority, should have decided the election? Does it not sound like you actually regarded yourself
furthermore as the actual congregation, but then in your own writing, that you made the minority the majority? In short, if you did not intend to
call as a separate party, your calling election was at that time not at all valid, since you were neither the majority nor the otherwise inner
necessary united vote of all the eligible voters of which the congregation at that time consisted. When Johann Dube, with numerous members of his
part, appeared in your meeting, to possibly have a united action in the matter of the call, you denied his request, and the chairman, George Mertink,
refused to let him speak. Naturally, Johann Dube with all those who were like minded thereupon left the meeting. Through the refusal to enter into
negotiations with that part of the congregation, you showed yourself as a self-founded party, and actually separated yourself from the congregation,
since you had in that party meeting called Pastor Palmer without participation of the other party. That you expressly say in your writing, that we
did not appear at the mentioned meeting, you acknowledge thereby, as a violent example, of how much your eye and ear witnesses saw how you erred, in
that they claimed just the opposite.
What now finally concerns the violence, lovelessness and law of the jungle, both sides were threatened, in that agitated time, in certain cases by
violence. But, according to our knowledge, there were no cases were these threats were carried out. Those involved, left it with the threats, or
were hindered and held back by friends. Should this statement not be sufficient, we add to it that the St. Paul congregation never condoned the use
of the law of the jungle nor acted it out, and also never instructed anyone to do so. The entire congregation cannot be held responsible for the sad
mistakes of individuals. It would certainly not be right for us, as an example, to hold the entire St. Peter congregation responsible for the
failures of individual members. That we brought up that, in that time, love did not reign in you, that when your church, where it now stands, was
built too close to us, it caused us anger and frustration, we have striking prove.
What further concerns the alleged violent expulsion, may it suffice to say, that our congregation paid all the claims on our church property to the
members of St. Peters who left us, and also the honest value for their labor.
Still one more, that Synod itself recognized the present St. Paul congregation for the actual old and original congregation in Serbin, that is shown
by the circumstances, that this congregation was accepted in the Synod in 1866, and since that time did not have to reapply for membership (See the
Synodical Report of the Alleghenny Synod from the year 1866). Contrary to this, the St. Peters congregation, according to the Synodical Report of the
Western District, was first formally accepted into the Synod in 1871.
Who dealt honorably for the glory of God and for the welfare of the congregation and who has not departed from that, we do not want to judge or
decide, but rather leave that to the Lord, who knows the true intentions of the heart of those involved, and who will once give his decided final
judgment.
With this, our strong best intentioned declaration, over the question whether a unification in Serbin is desirable and advisable, and in itself not
be injurious to Christianity, we say there can and may be differing opinions, and we close this our writing, and hope that this may be the last word
in the consideration of this matter.

An die luth. St.Petri Gemeinde zu Serbin, Lee County, Texas
Liebe Brüder in Christo!
Es thut uns wirklich schon um Eurentwillen leid, das Ihr Euch in Eure Schrift als völlig Unschuldige und Gerechte darstellen könnten im Bezug auf die
1870 zigen Trennung. Sollte Ihr als Christen nicht bedacht haben, das grade besonders bei Trennungen und Gemeinde spalltungen die sündige Natur der
Christen sich gewaltig ins Heiligthum einzudrägen pflegt? Wollt Ihr wirklich behaupten und dabei bleiben, das Ihr allein richtig gehandelt und daher
schuldlos seid an jener traurigen Begebenheit, die einer Zeit in der Gemeinde Zu Serbin stattfand? Ihr sagt in Eurer Schrift: “Es steht uns fest, das
im Jahre 1870 in der ev. luth. Gemeinde zu Serbin, Bastrop Co., Texas eine Trennung stattgefunden hat und zwar nach der Amtsniederlage des sel. P. J.
Kilian”. Gewis was die Zeitfolge anbetrifft, so geschah die Trennung allerdings erst nach die Amtsniederlege des sel. P. J. Kilian’s. Diese Trennung
im Jahre 1870 hätte aber, lieben Brüder, nicht geschehen können, selbst auf in dem Falle nicht des sel. P. J. Kilian sein Amt niederlegt hätte, wan
nicht die eigentliche vor Gott viel schlimmerer Trennung, nämlich die innerer und völlig eingetreten wäre. Oder ist das etwas eine geringfühige
Sache, wenn in einer Gemeinde inner Uneinigkeit die Herzen trennt? Is etwas blos die ausern Trennung schlimm? Ist nicht die innere Trennung als die
vorberentende und bewirkend Ursache der auseren Trennung viel schlimmer und verdamerther? Jedemann von Euch wird gewis zugeben das jedermal? Die
innere Trennung und Zerspaltung sonst Christlichen Herzen das allerschlimmste der eigentliche Giftlenden ist, auf welche dann die auseren Trennung als
die letzte trauriche Frucht wächst? Und nun fragen wir Euch: Bezeugt nicht die damalige Geschichte der Serbin Gemeinde deutlich, das nicht erst mit
dem Jahre 1870, wo die Amtsniederlage geschah, die Trennung began, sondern die eigentliche vor Gott am meisten zu beklangende Trennung war leider
schon im Herbste des Jahres 1869 völlig eingetreten. Trotz aller noch bestehenden auserlichen Verbindung war die Gemeinde schon zu der Zeit
thatsächlich innerlich zerrisen in zwei Theilen gespalten. Das beweisen alle damals abegehaltenen Versammlungen, die durch Bitterkeit und Steitsucht
eine gar traurige ‘Beruhenheit’ erlangt haben. Das beweist ferner der damals günzlich daniederlegende Kirchbau grade wegen inneren Zerrisenheit muste
das ganze Jahr 1869 hindurch der Fort und Weiterbau der Steinkirche die vorher von der ganzen inerlich noch einigen Gemeinde beschlossen und bereits
in Angriff genommen worden war, günstlich unterbrochen werden. Das beweisen weiter die damaligen Briefe des sel. P. J. Kilian. Das beweist endlich
auch der sel. Präses Bünger selbst in einem Briefe an den sel. P. J. Kilian vom 18 October 1869 datiert wo wörtlich Folgendes geschrieben steht: Ich
hoffe, so schrieb Pastor Bünger, das die Flammen der Streitheit in Ihrer Gemeinde durch Mittheilungen und das Verhalten des Herrn Wukasch und durch
die Vorstellungen an Herrn Leubner wird, wenn nich ausgelöscht, doch gedämpft worden sein. Eine Versammlung haben wir wegen der Angelegenheit doch in
Fort Wayne gehabt. Zu derselben gehört Herr P. Fick, Herr Dir. Lindemann, Herr Wukasch und ich. Im ganzen könnten wir das Verhalten des Herrn
Leubner nicht billigen. Es sollte mir sehr leid thun, wenn Herr Leubner sich durch die Vorstellung, die Herr Dir. Lindemann ihm machten wollte, nicht
zufrieden stellen lies. Ich will das nicht fürchten. Ich will auch hoffen, das die Gemeinde wieder ‘ganz’ ist und keine zwei Parteien bestehen.
Dieser Auszug beweist jendenfalls, das schon im Herbste des Jahres 1869 die Gemeinde zu Serbin innerlich zerspalten und zerrisen gewesen sein muste
war. Herr Matthes Wukasch, ein jetzt noch lebendes Glied der St.Petri Gemeinde wird gewis jeder Zeit bezeugen, das die oben erwähnte Berathung bei
Gelgenheit der Allg. Synode in Fort Wayne wirklich stattgefunden hat und auserdem kann jeden, der es begehrt, den genannten Brief des sel. Präses
Bünger’s zur Einsuchnahmen von P. H. T. Kilian vorgelegt werden.
Ja, wenn die Gemeinde zu Serbin nicht schon vor der Amtsniederlage des sel. P. J. Kilian zerrisen, zerspallt und innerlich gänzlich zertrennt war,
wozu war es dann nöthig, das Visitator Brohm im Jahre 1870 kurz vor der Amtsniedelage des sel. P. J. Kilian sich ernstlich bemühte, einer Einingung
und Versöhnung herbeizuführen. Beweist dieser Umstand icht mehr und klaar, als es all Worte thun können, das dieser Ris in der Serbin Gemeinde nicht
erst durch die Amtsniederlage geschaffen wurde, sondern schon vorher da gewesen mus. Grade auf dieser innere Zerrisenheit konnte sich der sel. P. J.
Kilian als auf eine allbekannte vollendett Tatsache berufen ohneWiedersprechen damit sogar sein Amtskündigung begründen. Aus allen diesem folgt, das
es falsch ist, wenn man die Trennung als eine Sache darstellt, die erst durch die Amtsniederlage des sel. P. J. Kilian herbeigeführt und geschaffen
wurde. Nein, die eigentliche, die innere Trennung war obwohl beklangenwerth doch nicht mehr wunderbar, sondern eine sich nothwendig ergebende Folge
aus dem damaligen Zustände innerer Zerrisenheit.
Nun, geliebte Brüder, die Ihr damals betheiligt waret, könnt Ihr auf die Jahre 1869 und ’70 zurückblicken Euch freisprechen vom Schuld? Seid Ihr nich
mitschuldigtt an jener innere Trennung sonst Christliche Herzen? Wenn jene kirchlichen Mistände und jene unüberwündlich schwierigen Verhältnisse,
welche Ihr in Eurer Schrift andeutet, nicht zum gutten Theil war mit Eure selbststeigende Shöpfung? Findet Ihr, wenn Ihr Eurer damaligen Verhalten
einer ernsten Prüfung unterzeicht, nicht sogar reiche Verannlasung zur Selbstdemütigung? War nich allein schon das verwerflich, das Ihr überhaupt
Partieleute wart? Darf dann ja ein Christ zu einer Parteinamen werden? Ferner bedenkt das Ihr für Euren ganzen damalige Streiterei nicht einmal
einen guten ehrevollen Grund aufzeigen könnt. Es waren nich Sachen der Lehre, es war auch nicht muthwillig Untreü im Amt oder gottlosen Lebens
wandell des damaligen Pastor, kurz es war überhaupt kein solcher Grund vorhanden, das nach bibliche Lehre stichhaltich und ehrenwoll wäre und trotzt
alle dem wurde doch mit grosser Bitterkeit gestritten und die Gemeinde zetrennt? Ist es nun nich sündlich, wenn Christen unter sich straiten und das
noch dazu ohne gerechte biblischen Grund? Oder könnt Ihr kurz und bündig irgend einen biblerich stichhaligen Grund des damaligen Streit nammen? Der
sel. P. Palmer wenigsten legte vor seiner Abreise auch Serbiner als berufenen Seelsorger der St. Petri Gemeinde in einen Briefe an P. J. Kilian das
Geständnis ab: “Ich bin über den eigentlichen Grund der Trennung in Ihrer Gemeinde durchaus, noch nicht klar”. Wir namen hieraus schliesen zu dürfen,
das keine wirkliche Vorhanden sein eines stichhaltigen gerechten Grundes es doch sehr leicht hätte sein müsten, den eignen so aber berufenen
Seelsorger zu überzügen. Die Vorlage auch diese so eben erwähnten Briefes is beim P. H. Kilian zu haben.
Ihr sagt in Eurem Schreiben: Wir halten nun dafür wenn ein Pastor sein Amt niederlegt die Gemeinde sich gezwungen sieht, einen andern zu berufen.
Die Rechtigkeit dieses Satzes wird selbstverständlich jederman einlauchten. Gewis berufen mus eine Gemeinde, aber wohl gemerkt: es mus das dann aber
auch wirklich die ganze Gemeinde sein, die da beruft und nicht irgend eine beliebige Partei aus der Gemeinde. Als Ihr sogleich nach den
Amtsniederlage des sel. P. J. Kilian zur Berufung eines neün Seelsorger geschritten sind, so wart Ihr nicht in Wahrheit die Gemeinde von Serbin,
sondern nur eine einzelnen Partei der Serbian Gemeinde und also solche habt Ihr berufen.
Wolltet Ihr nicht als Partei berufen, so hätte Ihr mit zeitweiligen Stimmung zugleich Wahlt mit dem andern grösten Theil der Gemeinde voraus
Unterhaltungen anknöpfen müssen zu einem etweigen gemeinsammer Vorgehen in der Berufsache. Ohne ein solches getroffene Übereinkommen muste jeder Wahl
unter dem damaligen Christenden als einseitig und als Parteiwahl angesehen und betrachten werden. Was sonst bei normalen Verhältnisse einer Gemeinde
ohne zweifel ganz richtig ist, nämlich das sich die abwesenden Glieder ihres Stimmrecht begeben, kann zur keiner Anwendung da, wo der Zustand einer
Gemeinde selbst unser Regel ist wo z. b. zwei Theile sich abschliesend gegenüber stehen und der eine Theil die Beschlüsse des andern Theil gar nicht
als für sich verbindlich annerkönnt. So wie die Sache damals standen konntet Ihr auch nicht so ohne weiteres sagen. P. Palmer ist doch als Prediger
der Gemeinde berufen, sondern Ihr müstet wenn Ihr nicht unmasened sein wolltet sagen: Unsere Partei hat P. Palmer berufen. Oder was es nicht etwas zu
viel verlangen, das die Majorität die Wahl der Minorität zu der ihrigen mache sollt? Stimmet sich nicht überhaupt eigentlich aus das Ihr Euch schon
weiter als die eigentliche Gemeinde betrachtet und dann doch zuletzt in Eürn ergenen Schrift bekannt, das Ihr als die Minorität der Majorität habt
machen müssen? Kurz, wenn Ihr nicht als eine gesonderte Partei berufen haben wollt, so war ja Eure Preidiger Wahl von damals überhaupt nicht giltig,
da Ihr dann weder die Majorität noch die sonst innerer erforderliche Einstimmigkeit aller stimmberegtigen die die damalige Pfaar Gemeinde zu Serbin
ausgemacht haben, für Euch gehalt habt. Übringens kann auch noch beweisen werden, das Ihr als Partei habt berufen wollen. Als Johann Dube mit
mehrenern Glieder dieses Theiles bald nach der Amtsniederlage des sel. P. J. Kilian in Eurer Versammlung erschienen und wo möglich ein gemeinsames
Vorgehen in der Berufssache zu ermöglichen wurde sein dahin gehandert Antrag abgewiesen und ihm schlieslich vomVorsitzer George Mertink das Wort
verweigert. Natürlich verlies hierauf Johann Dube mit allen die Ihm gleich gesinnet waren, sofort jene Versammlung. Durch die Weigerung auf
Verhandlunge einzugehen mit dem Theil der Gemeinde, habt Ihr Euch als eine für sich selbst handelende gefunderte Partei bezeugt und Euch thatsächlig
von der Gemeinde getrennt, indem Ihr dann noch in derselben Partei Versammlung P. Palmer ohne jedliche Mitwerkung des andern Theil berufen habt. Das
Ihr in Eurer Schrift uns drücklich sagt, das wir zu der besagten Versammlung gar nicht erschienen wären, so erkannt hieraus als aus einem
handgriflichen Beispiele, wie sehr sich Eure Augen und Ohrenzeugen geirt haben müssen, indem sie das Gegentheil behaupten.
Was nun zuletzt die Schlage, Liebe und Faustrecht anbetrifft so ist wohl in jener aufgeregten Zeit in einigen Falle und zwar von beiden Seiten mit
Schlagen gedroht, aber die Drohungen sind unsers Wistens von keiner Seite und in keinen Falle wirklich ausgeführt worden. Die Betreffenden liesen es
entweder bei bloser Drohung bewanden oder wurde von ihren eigenen Freunden an der Ausführung verhindert und zurückgehalten. Sollte dies Erklärung
noch nicht genügen, so setzen wir hinzu, das die St.Pauls Gemeinde nie das Faustrecht gebilligt noch ausgeübt hat, auch hat sie einandern ja
beauftracht, irgend jemanden Prügel zu verabreichen. Für traurige Fehler einzelener kann doch eine ganze Gemeinshaft nie verantwortlich gemacht
werden, es wäre doch noch gewis sehr unrecht von uns, wenn wir z.b. die ganze St. Petri Gemeinde verantwortlich machen für wirkliche vorgekommenen
Fehler ihrer einzelnen Glieder. Des übringens in jener Zeit auch bei Euch die Liebe nicht sonderlich gewaltet haben kann, dafür ist ein schlagender
Beweis Eure uns so sehr nahe gebaute Kirche, die augesprochenermasen uns zum Ärger und Verdrus dort, wo sie jetzt steht, hingebaut worden ist.
Was ferner die Angebliche gewaltsam Vertreibung anbetrifft, genügt es zu sachen, das diese Gemeinde den abgehenden Gliedern der St. Petri’s Gemeinde
alle ihre Ansprache auf hiesigen Kirchbau eigenthum sammt orderlich ausgezahlt hat.
Noch eines, das die Synode selbst die jetzige St.Paul’s Gemeinde für die eigentliche, alte und ursprüngliche Gemeinde von Serbin gehalten haben mus,
das beweist zur genüge der Umstand, das diese Gemeinde im Jahre 1866 in die Synode aufgenommen und seit jener Zeit keines Aufnahme mehr bedürft hatte
(Vgl Synodalbericht Ally. Synode vom Jahre 1866). Dagegen ist die St. Petri Gemeinde laut Synodalsbericht Westl. Districts im Jahre 1871 förmlich in
die Synode erst aufgenommen worden.
Wer damals zur Ehre Gottes und zum Heile seiner Gemeinde gehandelt und wer davon abgegangen ist, das wollen wir nicht richten noch entscheiden,
sondern dem Herrn überfasten, der die wahre Absicht eines jeden damals betheiligen Herzen aufs allerbeste gekannt hat und darnach auch sein allein
entscheidenes Urthal einst sprechen wird.
Mit der festen wohlerwagenen Erklärung, das man über die Frage, ob eine unsern Vereinigung in Serbin wünschenwerth und rathsamlich selbst unbeschadet
des Christenthum verschiedener Mannung sein kann und darf, schliesen wir dies unser Schreiben und wünschen das selbe als unser letzten Wort in dieser
Sache betrachtet su haben.
Mit brüderlichen Grus und im Namen und Auftrag der ev. luth. St.Pauls Gemeinde zu Serbin, Texas unterzeichnet sich der Vorstand derselben,
