This Agreement this day made and entered into and between John Dube, Charles Teinert and Carl Lehman, Trustees of the Evangelical Lutheran Church of the County of Bastrop and State of Texas of the 1st and Charles Jungmichel, (Carl Michalk, Andrew Kieschnick,) Andrew Wuensche, Michael Kurio, John Urban, George Mertink and Jacob Moerbe, a committee appointed by A. Kieschnick, F. Karcher, John Hattas, John Zischank, George Born, John Mitschke, Carl Peter, M. Wukasch, Andrew Falke, Traugott Zindler, John Biar, August Dube, M. Wagner, J. Mathietz, J. Pilack, W. Leubner, E. Lehman, (A. Lehman), Carl Lehman, H. Dung, A. Mericke, (A. Wuensche,) M. Domaschk, J. Arlt, (J. Dott), C. G. Wiederaenders, C. Dube, J. Urban, J. Moerbe, J. Biar Jr, A. Biele, J. Simne, M. Noack, J. Mertink, J. Urban, P. Scharrat, E. Dube, J. Urban Jr, John Falke, A. Leubner, F. Schlepegrell, Henry Schultz, (E. Menzel, J. Paulick, John Schneider, J. Schulze,) John Lehman of the second part, Witnesseth.

1st. For and in consideration of the covenants and agreements hereinafter mentioned of the said parties of the 2nd part and in compliance with resolution passed by said congregation, on the 20th day of September 1870 Have thus bargained sold, granted and conveyed and do by these presents bargain, sell, grant and convey unto the said parties of the second part and their successors for the use and benefit of those by whom said parties of the 2nd part were appointed committee as aforesaid as herein before named and specified a certain tract or parcel of land lying in said County near the town of Serbin, being a part of the Delaplain League and also being the same heretofore to the said parties of the 1st part conveyed for the use and benefit of said congregation and known as St Peters Church and other property except a small log house built by John Schoenig connected with and belonging to said church (including the land about fifty acres more or less upon which said church is standing, the said parties of the 1st part hereby binding themselves their heirs and assigns forever to warrant and defend said premises unto the said parties of the 2nd part and their successors in office and assigns forever to warrant and defend. The said parties of the 1st part do further covenant and agree to pay unto the said parties of the second part for the use and benefit of those by whom they were appointed as committee as aforesaid the sum of six hundred and twenty eight 23/100 dollars gold coin on or before the 1st day of January 1871. The said parties of the 1st part do also by these presents bargain, sell and transfer and deliver unto the said parties of the 2nd part the old church organ.

2nd. In consideration of this covenant and agreement of the said parties of the 1st part, the said parties of the 2nd part do for themselves and for those by whom they were appointed as a committee as aforesaid and pursuant to a resolution to a resolution passed on the 25th day of Sept 1870, Release and forever quit claim unto the said parties of the 1st for the use and benefit of said congregation all of their interest in and to a certain tract of land lying in said County about seventy-five acres more or less, being a part of the Delaplain League and known as the premises upon which the New Stone church and Old church belongs to said congregation now stands together with all the rights and tenements appertaining and erected upon the same. Also the new organ lately purchased by said congregation the said parties of the 2nd part, however reserving the right to use the cemetery on said premises conjointly with said congregation the said parties of the 1st part binding themselves their heirs and assigns to forever hold harmless the said parties of the 2nd part and these for whom they are herein acting of the payment of any and all indebtedness contracted as to be contracted in the erection of said new stone church and the purchase of said new organ and also to pay to such of the parties of the 2nd part and those for whom they are acting whatever money and labor and services may have been by them advanced and done for the erection of said New Stone church over and above the subscription of said parties respecting to the erection of said Stone Church also to pay to M. Wukasch whatever may be due him for money advanced for the purchase of said New organ it being understood that the parties of the 2nd part and therefor whom they are acting shall contribute a proportional amount to keeping in repair said cemetery, should they prefer to use the same, It being understood that the warrant herein given shall apply and extend to the congregation for which they are acting and not to themselves individually and privately.
